committed it is only that of failing to pay the Shroff the money earlier, and as I had the money in my pocket and never left the Office the whole day, and I could pay the money after I had finished my work and before the Shroff or myself had left the Office, there was no reason why I should not have done so beyond the fact of my attention to other and as I considered more important duties.
2. With reference to the second charge of improperly procuring the delay on the question of posting of the list, I beg to submit as follows:-
The usual course is for the list to be handed to the messenger by Mr. Sales at the close of the Office on the Thursday afternoon. On this particular afternoon of the 26th the list was handed to me and before leaving the Office I handed it to the messenger with instructions to post the list on the following morning. These are exactly the same instructions which I every month give to the messenger when I hand to him the Criminal cause list, not having any idea that the Summary Court list was posted differently to the Criminal cause list.
If I had known differently I certainly should have given the messenger instructions to post it the same evening and I trust I may be found innocent of this charge also.
I respectfully request to be allowed to add that I have now been Registrar's clerk for over 7 years, I have always tried to do my duty with my best abilities and always shall do so as long as I remain in the service.
I have never had a charge brought against me before and as regards my character I beg leave to refer to Mr. Justice Ackroyd and Mr. Bruce Shepherd who has been Acting Registrar.
